The Highly Skilled Migrant Programme (HSMP) was terminated on 30th June 2008 and replaced by the Tier 1 (general) scheme. Existing HSMP permits remain valid and may be extended under the new scheme if the holder can demonstrate that they meet its requirements.
Highly skilled workers, investors, entrepreneurs and foreign students who have graduated from a UK university can apply for working authorisation under the Tier 1 rules, a points-based system that is based on age, qualifications and earnings. Applicants must also score points for English language and availability of funds.
A specific job offer is not required for this route of entry, but the applicant must pass the points-based assessment before they can apply. This scheme is appropriate for those seeking self-employment or starting their own businesses in the UK, for people who would value the freedom of being able to change employers if desired, or for those who don’t have an employer to sponsor them.
Tier 1 – Highly skilled worker
This visa is issued for three years initially, with an option to extend for a further two years. It allows individuals to work on a permanent or contract basis and they must score 75 points under the attributes section - based on qualifications, previous earnings, age and UK experience - to qualify. They will also have to satisfy the English Language and maintenance requirement.
Tier 1 – Post study work visa
A post study work visa is issued for two years and allows recently qualified graduates to seek employment in the UK. Applicants must score 75 points under the attributes section - based on obtaining a degree level qualification or higher from a recognised institution. They will also need to satisfy an English Language and maintenance requirement.
Tier 1 – Entrepreneurs / investors
These are issued for three years initially and, for entrepreneurs, enable individuals who have £200,000 or more to set up or take over a UK business. For investors, individuals can come to the UK and invest at least £1 million.
